Terms and conditions

1 Applicability

 

1.1 Applicability

These general conditions apply to every offer from Coöperatie BooART Kunstbemiddeling UA, (“BooART”), and to every distance contract between you and BooART. These conditions are governed by Dutch law.

 

1.2 Amendments

We may amend these conditions from time to time. We will always notify you if we do so.

 

2 Our product range

 

2.1 Limited period of validity

If an offer has a limited period of validity or it is made subject to specific conditions, we always state this explicitly on our website www.booartstore.com.

 

2.2 Prices

All prices on our website include VAT but not handling and shipping costs and any taxes or other levies, unless otherwise stated or explicitly agreed.

 

2.3 Manifest errors

We are not bound by any manifest or obvious errors in our offers.

 

3 Your order

 

3.1 Agreement

An agreement between you and BooART is established after you have completed the order on the website and have received a confirmation email from us setting out the details of your order. Orders placed by anyone under the age of eighteen (18) will not be processed.

 

3.2 Shipping costs

3.3 Personal data

The personal data you disclose to us will be processed carefully and in accordance with our privacy policy. Click on privacy policy for further details.

 

3.4 Delivery

Our basic premise is that we deliver orders to the address indicated within five (5) working days, unless (i) a different delivery time has been explicitly agreed, (ii) BooART is subject to circumstances of force majeure, (iii) the product is not in stock, and/or (iv) the order is unusual, e.g. it requires gift packaging. Such orders will be delivered to the address provided by you within 30 days of concluding the agreement.

 

3.5 Delays

If a delivery is delayed – or only partial delivery is possible – we will inform you as soon as possible (usually within 24 hours) but no later than a few days after the date of the order. You then have the right to dissolve the agreement without cost.

 

3.6 Right of revocation

You have the right to cancel your order without stating reasons for up to fourteen (14) days after receiving the product. If you have ordered several products simultaneously but they do not arrive at the same time, this 14-day reflection period starts from the date you receive the last product.

 

3.7 Payment

Any amounts owed to BooART must be paid no later than fourteen (14) days after the start of the reflection period. For details on making payment, see our payment methods.

 

3.8 Reduction in value

Any use that you make of a product that is contrary to our general conditions will result in your being liable for any reduction in its value.

 

4 Product returns

 

4.1 Completion of form

If you wish to exercise your right of withdrawal, you can do so by filling in the model form and sending it to [email protected]. Alternatively, you can send an e-mail to [email protected] stating your name and address, order date and invoice details. We will send you an email confirming receipt of your request.

 

4.2 Returns

After invoking your right of withdrawal, you must then return the product within fourteen (14) days at the latest.

 

4.3 Packaging

The product must be returned in its original packaging and in accordance with our instructions. You are responsible for any damage caused to the product during its return shipment.

 

4.4 Burden of proof

As a consumer, you bear the burden to prove that you have exercised your right of withdrawal correctly and on time.

 

4.5 Costs

Any returned orders are entirely at your expense.

 

4.6 Reimbursement

We will refund you in full, along with any costs for delivery, within fourteen (14) days after we have received the returned product. The method of reimbursement will be the same as the payment method used for the order. However, if you used a more expensive method of delivery than the standard one, we will not refund the difference.

 

5 Questions or complaints

 

5.1 Description

If you have any complaint, email our customer service at [email protected]. Describe your complaint in detail in your email so that we can deal with it to the best of our ability. We will respond to your complaint within 5 days.

 

5.2 Disputes

If you are not satisfied with our handling of your complaint, you can submit it to the European Commission’s online dispute platform at: https://webgate.ec.europa.eu/odr/main/?event=main.home.show
